Starting from scratch? We make a new trademark application simple — a licensed attorney searches your name, picks the right filing basis, classifies your goods, and files it for you. Flat fee, no hourly billing.
Starting a new trademark registration
Which filing basis is right for you?
Every new application is filed on one of two bases. Choosing correctly matters — we help you decide.
Already using the name — "Use in Commerce" (1a)
If you're already selling goods or services under the mark, you file on a use-in-commerce basis and submit a specimen showing real-world use. This can go straight through to registration.
Not selling yet — "Intent to Use" (1b)
Planning to launch but not selling yet? File on an intent-to-use basis to lock in an early priority date now. Once you're using the mark, you submit a Statement of Use (or an extension) to complete it.
What's included in your new application
One flat fee covers the full attorney-led filing for one international class:
- A federal database search on up to 3 name choices, with attorney advice on your chances.
- A comprehensive internet search for unregistered (common-law) uses by others.
- Selection of the correct filing basis (use-in-commerce or intent-to-use).
- Accurate classification of your goods and services.
- Preparation and filing of the application by a licensed attorney.
- Handling of procedural issues such as disclaimers at no extra charge.
- We become your attorney of record and keep you updated through registration.
What happens after you apply
Here's the path your new application follows.
-
Consultation & search
After a few quick questions, an attorney consults with you, searches your name choices, and advises on risk and the right basis.
-
Filing
We classify your goods and services and file a complete application with the USPTO.
-
USPTO examination
An examining attorney reviews it; we respond to any procedural issues or office actions.
-
Publication & registration
The mark publishes for a 30-day opposition window; with no successful opposition, your certificate issues.
Mistakes that sink a new application
Most refusals are avoidable. These are the first-timer pitfalls a licensed attorney prevents — and the reason "filing services" so often fail their customers.
- Filing with no real search — running straight into a confusingly similar mark and a likelihood-of-confusion refusal.
- Choosing a merely descriptive name that the USPTO won't register as-is.
- The wrong filing basis — e.g., claiming use in commerce when you aren't selling yet.
- Overbroad or vague classification that wastes fees or triggers an office action.
- A bad specimen — or worse, an edited or fabricated one, which can sink the whole application.
