A U.S. trademark registration can last indefinitely, but the USPTO requires you to periodically file maintenance documents proving you still use the mark. Miss a filing window and the USPTO will cancel your registration — ending your nationwide protection. Renewal keeps your registration (and your priority date) alive.

Your trademark maintenance timeline

Three recurring milestones keep your registration active for life:

Years 5–6 — Section 8 & 15

File a Section 8 Declaration of Continued Use, plus a Section 15 Declaration of Incontestability (if eligible) to strengthen your registration against challenges.
Years 9–10 — Section 8 & 9

File a Section 8 Declaration of Use and a Section 9 Renewal Application to renew the registration for another ten years.
Every 10 years thereafter
