What is trademark maintenance?
A U.S. trademark registration can last indefinitely, but the USPTO requires you to periodically file maintenance documents proving you still use the mark. Miss a filing window and the USPTO will cancel your registration — ending your nationwide protection. Renewal keeps your registration (and your priority date) alive.
Your trademark maintenance timeline
Three recurring milestones keep your registration active for life:

Years 5–6 — Section 8 & 15
File a Section 8 Declaration of Continued Use, plus a Section 15 Declaration of Incontestability (if eligible) to strengthen your registration against challenges.

Years 9–10 — Section 8 & 9
File a Section 8 Declaration of Use and a Section 9 Renewal Application to renew the registration for another ten years.

Every 10 years thereafter
Repeat the Section 8 & 9 renewal each decade. Done on time, your trademark stays protected forever.
Deadlines are strict. If you miss a window, a 6-month grace period (with an extra government fee) may still apply — but after that, the registration is cancelled, and you'd have to start over with a new application and lose your original priority date. That's why we monitor your dates for you.
Changed owners since registration? If your trademark was sold or moved to a new entity, the USPTO requires the registration to be in the correct owner's name —
you can't renew until the assignment is recorded. We can
record your trademark assignment first so your renewal goes through.

When do I need to renew my trademark?
Between the 5th–6th year after registration (Section 8 & 15), again between the 9th–10th year (Section 8 & 9), and every 10 years after.
What happens if I miss a renewal deadline?
Your registration is cancelled and you lose federal protection — you'd have to file a new application and lose your original priority date. A 6-month grace period (with an extra government fee) may apply right after the deadline.
